1. Acceptance of Terms
By accessing and using the Mountain platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Mountain provides a quantum computing platform specifically designed for power grid optimization, including:
- Access to quantum computing backends (NVIDIA CUDA-Q, IBM Qiskit Runtime, Amazon Braket)
- Grid optimization algorithms and simulations
- Power flow analysis and modeling tools
- Grid library and data management services
- Analytics and visualization capabilities
3. User Accounts and Registration
3.1 Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these terms
3.2 Account Approval
- New accounts require administrative approval before activation
- We reserve the right to deny access to our services at our sole discretion
- Academic and research accounts may have different terms and conditions
4. Acceptable Use Policy
4.1 Permitted Uses
- Power grid optimization and analysis
- Academic research in quantum computing and power systems
- Development of grid resilience and reliability solutions
- Educational purposes related to quantum computing
4.2 Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload malicious code, viruses, or harmful software
- Attempt to gain unauthorized access to other accounts or systems
- Use the service for cryptocurrency mining or similar computationally intensive tasks unrelated to power grid optimization
- Reverse engineer or attempt to extract proprietary algorithms
- Share account credentials with unauthorized parties
5. Quantum Computing Resources
5.1 Backend Access
- Access to quantum backends is subject to availability and quota limits
- We prioritize quantum backends based on efficiency and cost optimization
- Backend maintenance and downtime may occur without prior notice
- NVIDIA CUDA-Q access is provided under partnership terms
5.2 Usage Quotas
- Daily and monthly computation limits apply to all accounts
- Quota overages may result in temporary service suspension
- Enterprise customers may request custom quota arrangements
- Unused quota does not roll over to subsequent periods
6. Intellectual Property
6.1 Platform Rights
- Mountain retains all rights to the platform, algorithms, and proprietary software
- Users retain rights to their input data and computational results
- Grid models and data uploaded by users remain their property
6.2 User Content
- You grant us a license to use your data solely for providing the service
- We do not claim ownership of your quantum circuits or optimization problems
- Aggregated, anonymized usage data may be used for research and improvement
7. Privacy and Data Protection
Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy and Data Policy. By using our service, you consent to the collection and use of information in accordance with these policies.
8. Service Availability
- We strive to maintain high service availability but do not guarantee 100% uptime
- Scheduled maintenance will be announced in advance when possible
- Emergency maintenance may occur without prior notice
- We are not liable for service interruptions beyond our reasonable control
9. Pricing and Payment
9.1 Free Tier
- Basic access is provided free of charge with usage limitations
- Free tier access may be modified or discontinued at any time
9.2 Paid Services
- Premium features and increased quotas are available for a fee
- Pricing is subject to change with 30 days notice
- Payment terms are specified in separate commercial agreements
10. Limitation of Liability
Mountain shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Mountain from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.
12. Termination
- Either party may terminate this agreement at any time
- We may suspend or terminate your account for violations of these terms
- Upon termination, your right to use the service ceases immediately
- We will provide reasonable notice for non-breach terminations
13. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the service after changes constitutes acceptance of the new terms.
14. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the service shall be resolved through binding arbitration.
